Havanna Luxury Yacht Charters Terms & Conditions
By booking a charter with Havanna Luxury Yacht Charters, guests agree to pay the applicable charges and be bound by the following terms and conditions.
1. Weather & Itinerary
Return Times
Return times may vary due to weather or unforeseen circumstances. No compensation will be offered for late returns.
Destination & Anchorage
The Master of the Yacht (Captain) will determine the final destination and anchorage on the day of charter based on safety and weather conditions. Requested locations cannot be guaranteed.
Outer Reef Charters
Outer reef charters operate only in winds up to 15 knots for guest comfort and safety. Alternative locations will be offered if conditions are unsuitable.
Extreme Weather
In the event of extreme weather (e.g., named cyclone), Havanna will cancel the charter for guest safety. An alternative date will be offered or a full refund provided.
Activity Limitations
No compensation will be offered for missed activities, water toys, or locations due to weather or operational limits.
2. Onboard Policies
General Rules
- Shoes are not permitted on board
- Smoking is allowed in designated outside areas only
- All guests must follow directions from the Master and crew at all times
Safety Compliance
If safety instructions are not followed, or if the safety of guests, crew, or vessel is at risk, the Master may terminate the charter and return to port. In such cases, no refunds will be provided.
3. Conduct & Behaviour
Prohibited Behaviour
The following behaviours are strictly prohibited and may result in early termination of the charter:
- Rowdy or unruly behaviour
- Excessive consumption of alcohol
- Consumption of illegal substances
- Disposal of rubbish over the side of the yacht
Consequences of Unacceptable Behaviour
At the sole discretion of the Master or Havanna, unacceptable behaviour may result in:
- Early termination of the charter
- Discharge of passengers at the nearest safe location
- Summons of police
Costs & Fines
- Any costs associated with early termination due to unacceptable behaviour will be borne by the guest
- Guests will not be entitled to a refund for early termination due to unacceptable behaviour
- Any fines imposed by relevant authorities with respect to rubbish thrown overboard or any other claim or cost incurred due to unacceptable behaviour will be the responsibility of the guest
4. Guest Responsibilities
Guests must use the vessel and all equipment with reasonable care. Guests are responsible for the cost of:
- Damage to the vessel, furnishings, or equipment caused by guests or their invitees
- Replacement of any non-repairable or lost recreational equipment
- Excessive cleaning due to misuse
- Any damage caused by negligence or failure to follow instructions
5. Luggage
We encourage packing lightly to maximize space on board.
Recommended: One small suitcase and one carry bag per person
6. Children
Age Policy
All ages are welcome aboard Havanna.
Supervision
Children must be supervised by a responsible adult at all times.
Safety Equipment
Children under 3 years of age and any non-swimmers must wear a PFD (Personal Flotation Device) life jacket at all times while onboard.
7. Insurance & Liability
Havanna’s Insurance
Havanna holds US$25 million public liability insurance.
Guest Insurance
Personal health and travel insurance is strongly recommended for all guests.
Limitation of Liability
The Master and crew will always act in the interest of safety, but Havanna accepts no liability for personal injury, property loss, or any unforeseen incident occurring during the charter.
To the extent permitted by law, Havanna shall under no circumstances be liable to the guests for any loss, damage, claim, injury, or harm sustained or incurred by the guests or a passenger as a consequence of or resulting directly or indirectly from the charter, including as a result of any default, fault, or negligence of Havanna, the Master, or any crew, employee, agent, or contractor of Havanna, or for any indirect or consequential loss of any nature.
In any event, the liability of Havanna, its servants, agents, and sub-contractors is limited in accordance with the Limitation of Liability for Maritime Claims Act 1989 (as amended, re-enacted, or replaced).
8. Additional Charges
Settlement of Expenses
Any outstanding onboard expenses must be settled with the Master via cash or credit card prior to disembarkation.
Additional Costs
The following items are not included in the standard charter fee and will be charged separately:
- Crew gratuity (at guest’s discretion)
- Special request wines and liquors not included in the standard beverage package
- Dockage at charterer’s request (other than initial pick-up and drop-off)
- Dinners ashore
- Shore-side transfers and excursions
- Shore lodging
Such additional costs will be charged to the guest’s credit card.
9. Maximum Guest Capacity
Day Charters: 22 guests (21 if a private chef is hired)
Overnight Charters: 11 guests
Changes to guest numbers are permitted up to 14 days prior to departure, subject to vessel capacity and availability.
10. Authority of the Master
The Master (Captain) has final authority on all matters relating to:
- Safety of passengers, crew, and vessel
- Itinerary and destination decisions
- Weather-related operational decisions
- Enforcement of onboard policies
- Termination of charter if necessary
All guests must comply with the Master’s instructions at all times.
